TERMS OF SERVICE

Photography & Videography Services

Jacob Daidone – Mobile, Alabama

1. Business Information

These Terms of Service (“Agreement”) are entered into by Jacob Daidone (“Photographer/Videographer,” “I,” “me”) and the client (“Client”).

Services are provided in and around Mobile, Alabama, unless otherwise agreed.

Jacob Daidone operates as an individual sole proprietor and not as an LLC or corporation.

2. Services Offered

Services may include, but are not limited to:

• Photography

• Videography

• Photo and video editing

• Portrait sessions

• Automotive photography and videography

Specific deliverables, shoot duration, and pricing will be agreed upon prior to booking.

3. Booking, Deposits, and Payments

• A non-refundable deposit of 25% of the total price is required to secure the Client’s booking date and time.

• The deposit applies toward the total cost of the session.

• Final payment is due before delivery of any photos or videos.

• Accepted payment methods include:

  • Cash

  • Cash App

  • Venmo

  • PayPal

  • Apple Cash

  • Invoice-based payments

Failure to submit final payment may result in delayed or withheld delivery.

4. Cancellations & Rescheduling

Client Cancellations.

• A minimum of one (1) week notice is required to cancel a session.

• Deposits are non-refundable, regardless of cancellation reason.

• If the Client requests to reschedule with less than one week’s notice, a rescheduling penalty may apply and is determined at my discretion.

Photographer Cancellations

• If I must cancel due to weather, emergency, illness, or unforeseen circumstances:

  • The session may be rescheduled, or

  • A discounted rate may be offered for a future session
    Final determination depends on circumstances.

5. Deliverables & Turnaround Time

Delivery Timeframes

• Photos: Delivered within approximately 2 weeks

• Video: Delivered within approximately 1 month

Deliverables

• Digital files only

• No physical prints

• RAW files are not delivered under any circumstances

Base Package Includes

• 15 edited photos

• 1 video between 20 seconds and 1 minute

Final image and clip selection is at the Photographer’s discretion.

6. Copyright & Usage Rights

• All content remains the exclusive property and copyright of Jacob Daidone.

• Clients are granted a personal-use license only, meaning content may not be:

  • Sold

  • Used commercially

  • Used for advertising or branding

  • Altered for resale

Photographer Usage

I reserve the right to use any photos or videos for:

• Portfolio

• Website

• Social media

• Promotional and marketing purposes

Clients may opt out of promotional usage only if requested in writing prior to the shoot.

7. Model Release & Minors

• Clients grant permission for themselves and any photographed subjects to be photographed or recorded.

• For minors (under 18), a parent or legal guardian must provide consent.

• This consent includes usage for portfolio and promotional purposes unless the Client opts out in writing.

8. Client Responsibilities

The Client is responsible for:

• Securing permits and permissions for shoot locations when required

• Ensuring location access if the shoot takes place on private property

• The behavior and cooperation of all subjects, guests, or participants

• Arriving on time and prepared for the session

Late arrival may reduce coverage time and does not warrant a refund or time extension.

9. Limitation of Liability

I am not liable for issues arising from:

• Weather conditions

• Equipment failure

• Missed or imperfect shots

• Client lateness or unpreparedness

• Subject movement or lack of cooperation

In the event of equipment failure or data loss despite reasonable care, liability is limited to:

• A reshoot or

• A refund of payments received (excluding the non-refundable deposit)

I am not responsible for indirect damages, lost profits, or emotional distress.

10. Creative Discretion

Photography and videography are subjective art forms. By booking, the Client acknowledges:

• Editing style, composition, and final selection are at my discretion

• Dissatisfaction with style alone is not grounds for refund

11. Governing Law

This Agreement shall be governed by and interpreted in accordance with the laws of the State of Alabama.
